Free Range Poultry Appeals with Costs
This case involved two appeals, a new 16,000 bird shed
and an extension to an existing shed.
The planning appeals were held by way of a Public Inquiry
and lasted two days. Witnesses on the issue of flies and
odours were a key component of the case.
Like many cases involving poultry there was a degree of
local opposition and residents represented themselves at
the Inquiry alongside the Local Authority’s Environmental
Health Officer. The Inspector had to decide whether there
was a potential detrimental effect on the amenities of local
residents. He concluded there wasn’t and granted the
planning permission for both proposals.
The Inspector also awarded costs against the Local Authority
due to their proven unreasonable behaviour, enabling the
applicant to recoup the costs incurred in fighting the appeal.

pleased with the outcome after a long battle involving the
initial preparation of an Environmental Impact Assessment
and two planning applications.
