Enforcement Notices

Undertaking development without planning permission can give rise to enforcement action from the Local Authority. Before an enforcement notice is served the Local Authority will normally send a Planning Contravention Notice requiring specific information such as ownership and key dates. Both notices will require your immediate action as there will be critical dates to adhere to.

If you don’t appeal against an enforcement notice the terms will take effect on a specified date. This will mean you will have to remedy the breach by that date or face action in court. If you appeal, this can be done on several different grounds including that planning should be given or that the breach took place too long ago (see Certificates of Lawfulness).
