Extended Opportunities For Temporary Land Uses

For all you looking to capitalise on the staycation boom this year, there may be some opportunity temporarily to do so without planning permission.  Schedule 2 Part 4 Class B allows for the use of any land for any purpose for not more than 28 days in total in any calendar year,

of which not more than 14 days in total may be for the purposes of the holding of a market, motor car and motorcycle racing including trials of speed, and practising for these activities, and the provision on the land of any moveable structure for the purposes of the permitted use.  It has been announced that from 1st January 2021 until 31st December 2021 an additional 14 or 28 days on top of the 14 or 28 days referred to above is allowed under the Act.

For activities such as temporary camping sites, to be able to operate additional days without the need for a full change of use for the land is hugely advantageous, particularly at this time when the industry is playing catch up.

It is important to note that development is not permitted under Part 4 new Class BA if:

(a) the land in question is a building or is within the curtilage of a listed building

(b) the use of the land is for a caravan site

(c) the land is, or is within, a site of special scientific interest, and the use of the land is for motor car and motorcycle racing including trials of speed or other motor sports, and practicing for these activities; clay pigeon shooting; or any war game, or

(d) the use of the land is for the display of an advertisement.
