Planning Permission Permission under Class Q(a) & (b) of the Permitted Development Right regulations 2015 was granted by West Devon District Council on 1st April 2019 under reference 0255/19/PDM for the conversion of the Barn at Downhayes Farm, Spreyton into two residential dwellings. The consent gives Class Q approval for 2no. dwellings, each with 4 bedrooms and open plan living space comprising of entrance hall, living room, kitchen and dining room. Additionally, there is a utility room and playroom/study. The dwellings have proposed floor areas of 201m² and 221m² respectively.
The application was supported by detailed elevation drawings and floor plans together with a structural appraisal prepared by Acorus Rural Property Services Ltd. However, these plans could be amended through prospective purchasers submitting a revised application to gain approval for the size and type of dwelling that they desire.
It has also been recognised, in the Appeal decision Mansell v Tonbridge and Malling BC  EWCA Civ 1314, that since a Class Q approval has been secured, this is a material planning consideration and can be used as a 'fall-back' position for a possible future application seeking replacement dwellings on the site of the Barn. This, therefore, means that there is potential opportunity for prospective purchasers to submit an application for an architecturally-designed dwelling to replace the Barn at Downhayes Farm.
The current prior approval determination states development must be completed not later than the expiration of three years from the date of the permission, i.e. 1 April 2022.
SERVICES Services such as water and electricity are available on or near the site. Private Drainage facilities will need to be provided by the purchaser.
TENURE The whole of the above property (shown edged red on the plan) is sold freehold with vacant possession on completion of the purchase.
