Planning Permission Granted at Appeal under Class Q to form 5 new Dwelling Houses

The Acorus South West office have obtained planning permission for a client in North Devon following a planning appeal for the conversion of an agricultural building to form 5 dwelling houses under Class Q of the GPDO.

The initial Prior Approval application was refused by North Devon Council as the planning officer determinded that  ‘’the proposal would require building works that would go beyond conversion alone to the extent that would constitute new build.’’

The appeal was submitted by Acorus on behalf of the client. The appeal was decided in the client’s favour and planning permission granted subject to a number of conditions.

The inspector stated in the determination that ‘’The proposed conversion would involve various building operations. However, these are permitted under Class Q.1(i) to the extent that they are reasonably necessary to allow the conversion of the building to function as a dwelling house. From the evidence before me and from my observations on my site visit, it seems to me that the existing building is sufficiently substantial to be capable of accommodating the proposed works. The new walls would simply delineate each unit and do not of themselves indicate that the building is unsuitable for conversion to residential use. Given the building’s substantial form, the building operations could not be reasonably described as starting afresh and would not be so extensive so as to amount to a complete or substantial re-build or new build. The appeal proposal would therefore involve building operations to the extent reasonably necessary for the building to function as a dwellinghouse.’’
