Acorus South West Planning Application and Class Q Successes

The South West Office have had a number of successful planning applications and prior notification submissions over the past month.
A new agricultural access was approved for a client in East Devon, improving the accessibility of the land for agricultural machinery and to limit farm traffic within the neighbouring village.
Submissions relating to the change of use of agricultural buildings to dwellings under Class Q permitted development have been approved in Teignbridge, West Devon and Mid Devon. One client is now considering a ‘fall back’ application to replace the approved conversion with a new build structure.
Planning permission has been gained for a client in Teignbridge for the removal of an agricultural occupancy condition, following a successful submission detailing the change in circumstances relating to the property and taking into consideration that a Certificate of Lawfulness had previously been approved relating to the breach of the occupancy condition for over 10 years.

Class Q - This is the permitted development of an agricultural building to residential use. There are criteria that apply i.e. the building must have been use solely for agricultural use on or before 20th March 2013; the dimensions of the building must not change; there must not be excessive rebuilding to enable the building to be converted into a dwelling. There are also restrictions on the number and size of dwellings the building can be converted to.
